S.B. 572 would allow such individuals to claim immunity shortly after they are charged with a crime and places the burden on prosecutors to present “clear and convincing evidence” that a crime has occurred before the case can move forward.
Research on “Stand Your Ground” laws in other states shows that these statutes do not decrease violent crime on average. In fact, in Florida, where the first “stand your ground” law was passed, firearm homicides increased by 25% to 45% in the years that followed, and there have been racial inequities in the application of the law.
